How to assure a copy of a passport in Ukraine?
Currently, one of the pressing issues when moving or registering possession of real estate abroad is the provision of a notarial copy and a notarized translation of a passport (this applies to both citizens of Ukraine and foreigners).
Also, a notarized copy of a passport is a mandatory document if a person plans to apply for a residence permit abroad or become a founder of a foreign company.
A similar requirement is present when opening accounts in foreign banks and other financial organizations, the terms of which are the mandatory submission of notarized copies of a certain list of documents - one of which is the passport of the person entitled to dispose of the account.
It is also worth saying that the Ukrainian legislation contained the provision of a direct prohibition on notarization of copies of any passports.
At the same time, it was possible to circumvent it legally, since the other provision of the Law of Ukraine “On Notaries” remained in force, which provided for this type of notarial act - issuing a certificate, the content of which was a confirmation by the notary of the identity of the citizen with the person in the photo who presented it. This certificate, which was printed on a special notarial form, contained a photograph (of the person who applied to the notary), which was sealed with a seal and a notary's signature on the stern, and in the text of which the passport details of the person shown in the photograph were also indicated.
However, not so long ago (the date of adoption of the document was 03/23/11, the date of entry into force was 04/11/2011), the Procedure for notarial actions of notaries in Ukraine, which is the main document in the work of notaries, made further changes, including the above mentioned a legal act was deleted item prohibiting to certify the correctness of copies of passports. Thus, from this time it became possible to certify copies of passports. To confirm the originality of the copy made from the original document, a prerequisite is the provision of the original document.
As practice shows, at the beginning not all notaries agreed to do this, but due to the high demand for this type of notarial action, there is still a tendency to meet customers' wishes.
Depending on the country in which the Ukrainian documents are provided, it should be noted that the practice was spread among Ukrainian notaries when it is certified that the passport copy is correct and the authenticity of the translator’s signature, which translated from Ukrainian into English, is certified, and the translation is attached to the copy of the passport and sealed and the signature of the notary. If necessary, an apostille may be affixed to such a document in the Ministry of Justice of Ukraine with a view to its further provision at the place of demand.
(which is not very convenient, because this process is carried out only in one place).
Certification of copies of passports of citizens of Ukraine, both internal and for traveling abroad is possible, both in itself and with the translation of their text into another language. At the same time, the translation can be done both by a translator (who has a bachelor's degree, specialist, and master's degree), as well as by the notary himself, if he is fluent in a foreign language.
So, for example, for the transfer at the place of demand on the territory of the Russian Federation a notary certified a copy of the passport of a citizen of Ukraine and at the same time certified the accuracy of the translation of the text of the document from Ukrainian into Russian.
It should be noted that notarized translations can be sewn both with to copies of documents, and with originals, for example:
in the original translation can be filed:
- certificates of non-conviction; from the place of study; from work; from ZhEK; from the bank;
- medical certificates;
- certificates of marital status;
- powers of attorney and statements;
- extracts from diplomas;
